Regardless of whether the buyer "invokes" warranty or guarantee in case of defective performance, they are entitled to four types of so-called warranty rights under Section 6:159 (2) of the new Civil Code: repair / replacement / price reduction / claim for refund (so-called withdrawal). Therefore, it is particularly important that the consumer is entitled to the same four types of rights in the event of a quality complaint related to a product covered by the statutory warranty and the mandatory guarantee.
According to the new Civil Code, in a contract where the parties are obligated to provide reciprocal services, the obligor is liable for defective performance under the warranty for defects. Based on a claim under the warranty for defects, the entitled party may choose between...
- may require repair or replacement, unless fulfilling the chosen warranty claim is impossible, or if it would result in disproportionate additional costs for the obligor compared to fulfilling another warranty claim, taking into account the value of the service in its faultless condition, the severity of the breach of contract, and the detriment caused to the entitled party by fulfilling the warranty claim; or
- the customer may demand a proportionate reduction in the price, may rectify the defect himself or have it rectified at the obligor's expense, or may withdraw from the contract if the obligor has not undertaken the rectification or replacement, is unable to fulfill this obligation under the conditions stipulated by law, or if the customer's interest in the rectification or replacement has ceased to exist.
The new Civil Code also contains the rule that withdrawal is not permitted due to insignificant defects. The law stipulates that rectification or replacement must be carried out within a reasonable timeframe, taking into account the characteristics of the item and its intended use as reasonably expected by the entitled party, while protecting the interests of the entitled party.
According to Section 6:166 of the new Civil Code, the costs associated with fulfilling the warranty obligation are borne by the obligor – that is, the business. An exception is if the failure of the item was also contributed to by the failure of the entitled party to fulfill their maintenance obligation; in this case, the entitled party is obliged to bear the costs incurred in fulfilling the warranty obligation in proportion to their contribution, provided they possessed knowledge regarding the maintenance of the item, or if the obligor fulfilled their information obligation in this respect.
According to the general rule of the Civil Code, the entitled party's claim for warranty for defects expires within one year from the date of performance. However, in the case of a contract between a consumer and a business, the warranty period is longer: the consumer's claim for warranty for defects expires within two years from the date of performance.
If the subject of the contract between the consumer and the business is a used item, the parties may agree on a shorter limitation period; however, a limitation period shorter than one year cannot be validly stipulated in this case either.
An important rule is that the part of the repair time during which the entitled party cannot use the item as intended is not included in the limitation period.
The limitation period for warranty claims restarts for the part of the item that is affected by the replacement or repair. This rule also applies if a new defect arises as a result of the repair.
The provisions defined in Section 6:157 (1) of the new Civil Code contain the cases of exemption from warranty liability, according to which the exemption can occur in two cases:
- if the defect was known to the entitled party at the time of the conclusion of the contract;
- if the defect was one that the entitled party should have been aware of at the time of the conclusion of the contract.
It is important to note that the seller is only exempt from warranty liability for defects known to the buyer – and it is only for such defects that sellers can legitimately say that there is no warranty (and the product cannot be exchanged for this reason, for example).
Merchants often attempt to illegally exclude liability for defective performance by claiming that no warranty or guarantee applies to sale or discounted items as a whole. However, according to the relevant legal regulations, a quality complaint can be made regarding a discounted (sale) product, specifically concerning the part of the product that was not defective, or was defective but the consumer did not (or could not) know about it.
If the buyer later returns the product to the store due to a defect that was not disclosed, the complaint must be handled, and it is unlawful to reject the claim by arguing that "there is no warranty on discounted goods."
There is a significant difference in the burden of proof between the two legal institutions. In the case of warranty – throughout the entire duration of both types of warranty – the party obligated to provide the warranty (the seller) is only exempt from liability if they prove that the defect arose after performance (for example, due to improper use by the buyer).
In contrast, under warranty, the buyer is generally obliged to prove their "case," i.e., that the cause of the defect was already present in the product at the time of purchase and that the defect was not caused by the buyer's improper use. However, in the case of warranty, an important rule applicable to consumer contracts – and an exception to the general rule – is that in the event of a defect discovered within 6 months of performance, it must be presumed (considered) that the cause of the defect was already present at the time of performance. Accordingly, the seller is only exempt from liability for a lack of conformity that occurs in the first six months if they prove that the product was faultless at the time of sale, i.e., that the cause of the defect arose after performance due to the product's improper use.
Therefore, both during the entire warranty period and the first 6 months of the guarantee period, the burden of proof lies with the obligor (the seller), meaning that they are only exempt from liability if they prove that the defect arose after performance.
It should be emphasized, however, that this presumption regarding warranty applies only to consumer contracts under the Civil Code; therefore, this rule does not apply to buyers who are not considered consumers under the Civil Code. For a buyer who is not a consumer to successfully assert their warranty rights in the case of a defect discovered within six months of performance, they must prove that the cause of the defect existed at the time of performance.
An exception to the exception, meaning the presumption referred to is not applicable, therefore the burden of proof still lies with the consumer even within the first 6 months of the warranty, if the presumption is incompatible with the nature of the item or the nature of the defect.
